MINUTES
EASTHAM BOARD OF HEALTH MEETING
THURSDAY, JULY 25, 2013 AT 3PM


Present:  Dr. James Taylor, Chair, Dr. Martin Haspel, Beverly Knox, Dr. Joanna Buffington, Jane Crowley, Susan Barker

Dr. James Taylor reminded everyone regarding this.


  • OPENING STATEMENTS
Jane Crowley provided the following updates:
  • Beach testing is being done weekly on Wednesday and the result is reported to us on Thursday.  A link to the County website of beach testing is on the Town of Eastham’s website
  • Routine water tests are required for rentals and we will use the nitrate result in those tests as part of the overall nitrate data
  • Susan will provide a summary overview of the rental inspection and testing program at the July meeting
  • Great Pond is the 2nd pond to receive remediation.  Sediment testing has begun and the window of treatment time has been set for September 15 through mid November.  Treatment will be done based on the environmental conditions during that window of time.  
  • Household Hazardous Waste Day was held on Saturday, July 20, 2013 in Eastham.  This is a joint effort between Orleans and Eastham.  The next event will be hosted by Orleans on September 21, 2013.
  • Emergency management testing was done and Eastham did very well.

Chris Wickson, East Cape Engineering, presented.

These are 2 identical lots that have less than 30,000 square feet per lot.  The proposal is to build 2 three bedroom houses with an Advantex Innovative Alternative System.  To proceed, Board of Health approval for provisional use is required.

During the discussion, it was noted that the:
  • basements would be unfinished
  • garages would be 1 story only
  • each house would have 1,736 sq ft of living space, not including the basement
These lots are in the test areas for 1, 4 Dioxane.  When the wells are drilled, the BOH would appreciate testing for 1, 4 Dioxane as well as the normal Routine and VOC parameters.

Beverly Knox made the motion to approve the proposed project with the following conditions:
  • Routine water and VOC quality test results be provided of existing well location to assure potability
  • No increase in design flow be allowed
  • Secondary treatment and monitoring under provisional use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use).  Effluent nitrate-nitrogen not to exceed 19 mg/L.
  • Deed restriction for 3 bedroom use and use Advantex alternative technology requirement to be recorded on deed
  • Designer to verify proper operation of the system prior to issuance of Certificate of Compliance
  • Any increase in habitable square footage would require Board of Health review.
  • Operation and maintenance agreement to be submitted to EBOH.  Operation and maintenance agreement to be required for the life of the system.  Operator to report results via Carmody Data Base provided through Barnstable County Health or directly to the Eastham Health Department if not available.

Jane Crowley confirmed that Glenn Dumont, McShane Construction, withdrew this review as the pending sale for the new condominium unit fell through and the new buyers may want a different house plan than these potential buyers had wanted.

Jane advised that she did take the opportunity to review with Mr. Dumont where they were at with Brackett Landing and the allowed bedroom count which must not be more than 76 as approved at the time of proposal for Brackett Landing.  The review confirmed that the project is currently up to 66 bedrooms.

The septic system at Brackett Landing is actually 2 systems – one to nitrify and one to de-nitrify.  The BOH would be interested in learning more about these systems and Jane agreed to plan a review of it at a future workshop.  Jane will email a copy of the plan to the EBOH for review prior to the workshop.

  • CORRESPONDENCE & OTHER INFORMATION
Jane Crowley advised that she had received a Reduction In Testing request from Tom Remmers regarding the septic system at Stewarts Seafood, 4380 State Highway, M-8, P-146B.  The reduction requested is the sampling for fecal coliform which was a requirement at the time of approval of the septic system.  Based on current standards, this requirement is no longer part of normal testing.

Dr. Joanna Buffington made the motion to approve the Reduction In Testing request

  • OTHER BUSINESS
  • Susan Barker provided an update and some history about the Rental Program in Eastham.  Beginning in 2009 to date, 735 rental inspections have been conducted.  In 2009 there were 1,212 registered rental properties.  In 2013 to date, there are 1,191.  Inspections are done on the first year of a rental property and then a percentage of properties are selected yearly based on the WQMP target area for nitrate screening.
  • Pat LaRiviere’s tenure on the Board of Health has expired and therefore, we have a vacancy.  Pat was the Vice Chair of the Board and therefore, we need a new one appointed.   Beverly Knox was nominated for this role.
Dr. Marty Haspel made the motion to appoint Beverly Knox as Vice Chair of the Board of Health

  • Jane Crowley and the EBOH reviewed the Water Management Plan and provided comments and edits.  Jane will update the document and send it to Charles Harris.  There will be a meeting on August 17, 2013 at 7PM
  • The project being proposed for the property where Finbars is currently located will require approval from the Board of Health in both Eastham and Orleans.  There is currently a joint meeting set up on August 15, 2013 to review the proposed plan.  A quorum is required from both boards.  Please let Jane know ASAP if you cannot attend so that the meeting can be reschedule.  The permit will be filed with Eastham.
  • The next workshop was set for August 12, 2013.  The main item on the agenda will be Windmill Weekend. At the July 22, 2013 workshop, the following were discussed:
  • Ticks
  • Lyme Disease
  • Flu Clinic
  • Hazardous Waste Disposal
  • Water
  • Sun Safety
One suggestion was to reduce the number of folders and handouts.
